Governing the relationship between A Beautiful Call Ltd and registered Artists on the platform

1. Introduction
These Terms and Conditions (“Artist Terms”) govern your registration and participation as
an Artist on the A Beautiful Call platform (“Platform”), operated by A Beautiful Call Ltd, a
company registered in England and Wales (“Company”, “we”, “us”, “our”).
By registering as an Artist on the Platform, you agree to be bound by these Artist Terms in
full. If you do not agree, you must not register or use the Platform as an Artist.
2. Definitions
• “Artist” means any individual or entity registered on the Platform to deliver Beautiful Calls.
• “Beautiful Call” means a live phone call delivered by the Artist to a Recipient, as booked
through the Platform.
• “Recipient” means the person who receives the Beautiful Call as a gift from a Buyer.
• “Buyer” means the person who purchases a Beautiful Call through the Platform.
• “Platform Fee” means the 20% commission retained by the Company on each completed
Beautiful Call.
• “Artist Earnings” means 80% of the booking price after deduction of the Platform Fee.
3. Artist Registration
To register as an Artist you must:
• Be at least 18 years of age.
• Provide accurate and complete information during registration.
• Connect a valid payment account (via Stripe Connect or other approved payment provider)
to receive payouts.
• Agree to these Artist Terms and all applicable policies.
The Company reserves the right to approve, reject, or remove any Artist registration at its sole
discretion.
4. Artist Profile
As a registered Artist, you are responsible for:
• Maintaining accurate and up-to-date profile information including your name, photo, bio,
repertoire, spoken languages, and pricing.
• Ensuring your profile content does not infringe any third-party intellectual property rights.
• Setting a price for your Beautiful Call. You are free to set any price you choose. The
Company takes no responsibility for the commercial success of any Artist’s pricing
decisions.
5. Delivering Beautiful Calls
Upon receiving a booking, the Artist agrees to:
• Deliver the Beautiful Call within the timeframe specified in the booking (typically 3 to 5 days
from receipt of booking).
• Call the Recipient’s phone number as provided at the time of booking.
• Perform the requested song or content in a live, sincere, and professional manner.
• Deliver the personal message provided by the Buyer to the Recipient during the call.
• Mark the booking as “Delivered” on the Artist dashboard after completing the call.
The Beautiful Call is a voice-only phone call. Video calls are not part of the standard service unless
explicitly agreed otherwise.
6. Content and Conduct
Artists agree not to:
• Deliver any content that is offensive, anonymous, discriminatory, abusive, sexually explicit,
or otherwise inappropriate.
• Contact Recipients outside of the context of the booked Beautiful Call.
• Share, sell, or exploit any personal data of Buyers or Recipients obtained through the
Platform.
• Record or distribute the full content of any Beautiful Call without the explicit consent of the
Recipient.
Artists may, however, record and share a short snippet of their own performance (excluding the
Recipient’s personal details and full name) for social media and promotional purposes, provided
they take all reasonable steps to protect the privacy of the Recipient.
7. Fees and Payments
The Company charges a Platform Fee of 20% on each completed booking. The Artist
Earnings of 80% will be paid out to the Artist’s connected payment account automatically
upon marking the booking as Delivered.
Payments are processed via Stripe or other approved payment providers. The Company is
not responsible for any delays caused by third-party payment processors.
The Artist is solely responsible for declaring and paying any applicable taxes on their
earnings in their country of residence.
8. Cancellations and Refusals
Artists may decline a booking by notifying the Company. Repeated refusals without
reasonable cause may result in suspension or removal from the Platform. If an artist feels to
take a pause for a while, we will pause the profile for the time the artist needs.
If an Artist fails to deliver a Beautiful Call, the booking may be cancelled and the Buyer
refunded at the Company’s sole discretion. In such cases, the Artist will not receive
payment for the booking.
9. Intellectual Property
Artists retain all intellectual property rights in their performances.
10. Termination
Either party may terminate the Artist’s participation on the Platform at any time with
reasonable notice. The Company reserves the right to immediately suspend or remove an
Artist in cases of breach of these Terms, misconduct, or actions that damage the reputation
of the Platform.
Upon termination, any pending earnings for completed calls will be paid out within 7 days.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any
indirect, incidental, or consequential loss arising from the Artist’s use of the Platform. The
Company’s total liability to any Artist shall not exceed the total amount paid to that Artist in
the 3 months preceding the event giving rise to the claim.
12. Governing Law
These Artist Terms are governed by the laws of England and Wales. Any disputes shall be
subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these Terms
The Company reserves the right to update these Artist Terms at any time. Artists will be
notified of material changes via email or platform notification. Continued use of the
Platform after notification constitutes acceptance of the revised Terms.
